Vol. II, Pg. 122:  Book U, "568. Page 467  10 Mar 1818, Mary McMaken (Spartanburg Dist) to Jesse Wheeler (same), for $300 sold all that tract of land containing 163 acres in said Dist. On the N.E. side of Middle Tyger river.  Border:  Edward Smith.  Witness Danl. Wilbanks, James Hendricks.  Signed Mary (x) McMaken.  Witness oath by James Hendricks 28 Mar 1818 to John Montgomery, J.P.  Rec. 3 Jan 1831."

Vol. III, Pg. 116:  Book X, "530.  Page 488-489  19 Dec 1838, John M. Collins (Spartanburg Dist) to Thomas & Joel Ballenger (same), for $1,650 sold a certain tract of Land in said Dist. Known by the name of McElhanys land, lying on both sides of Middle Tyger River.  Border:  James Reynolds, Edward Smith, John Loftis, Kilgore, parcel conveyed from Jesse Wheeler to above mentioned Collins, branch.  Supposed to contain 69 acres more or less.  Also another parcel adjoining the above.  Supposed to contain 13 acres more or less.  Border:  McElhany, Edward and Zechariah Baily.  Witness A. M. Thomson, Richard Ballenger, Danl. Robertson.  Signed Jno. M. Collins.  Witness oath by Richard Ballenger 20 Dec 1838 to John Chapman J. Q.  Dower relinquished by Edith (x) Collins 20 Dec 1838 to John Chapman J. Q.  Rec. 30 Apr 1841." 

Vol. III, Pg. 231:  Book Y, "Page 345-346  20 Sept 1841, Jesse Wheeler (Spartanburgh Dist) to John Wheeler, for $515.25 sold a certain tract of land in said Dist. on waters of North Tiger River.  Border:  James Loftis.  Containing 229 acres more or less.  Witness David (x) Wheeler, Alexander Wheeler.  Signed Jesse Wheeler.  Witness oath by Alexander Wheeler 12 Oct 1842.  Dower relinquished by Jane Wheeler 15 Jan 1844 to Thomas Ballenger J. Q.  Reg. 5 Feb 1844.  Original delivered to John Wheeler 24 July 1844."

Vol. III, Page 338:  Book Z, "Page 135-136   6 Oct 1845, Whereas Jane Wheeler and others on or about 19 Apr 1845, did exhibit their bill of complaint in the Court of Equity, said Bill being exparte praying for sale of lands belonging to the estate of Jesse Wheeler dec.  Cause came to be heard at the extra term of Aug 1845, when said Court did order that the tracts of land plattes Nos. 2, 3, 4 should be sold at public auction by the Commissioner.  T. O. P. Vernon as Commissioner, did on 6 Oct 1845, dispose of said lot unto D. Ballenger for $300.  Parcel platted as lot No. 3, bounded by lands of Henry Smith, John Wheeler, Mason & Lot No. 2.  Witness Wm. A. Collins  3 Nov 1845 to J. B. Tolleson Clk & Mag Ex off.  Reg. 3 Dec 1845.  Origl. Delivered to D. Ballenger 6 Apr 1846."

Vol. III, Page 340:  Book Z, "Page 140-141   6 Oct 1845, Whereas Jane Wheeler and others on or about 19 Apr 1845, did exhibit their Bill of Complaint in the Court of Equity, said bill being exparte praying for sale of land belonging to the estate of Jesse Wheeler Dec.  And the cause came to be heard at the extra term of Aug 1845, when said Court did order that the tracts platted Lots 2, 3, 4, should be sold at public auction.  T. O. P. Vernon as Commissioner, did on 6 Oct 18145, sell the lot unto John Staggs for $260.  Tract is Lot No. 2.  Bound:  Perry Smith, Mason, daughters land, lots No. 1 & 3.  Witness J. A. Miller, Wm. A. Collins.  Signed Thos. O. P. Vernon C. E. S. D.  Reg. 3 Dec 1845.  Original delivered to John Staggs 2 Feb 1846.  Witness oath by Wm. A. Collins 3 Nov 1845 to J. B. Tolleson Clk & Mag Ex off."

William Wheeler

DEEDS: Know all men by these presents that Robert McIntosh for and in consideration of The Sum of Three Hundred Dollars to him in hand paid by William Wheeler of the County of Yancy and State of North Carolina the receipt whereof is hereby acknowledged have Bargained Sold and Conveyed and by these presents does Bargain Sell and Convey unto the Said William Wheeler and his heirs all his  right title claim interesst and demand whatsoever Excepting one half of the minerals here by Exprefsly reserved unto the Said grantor and his heirs; in and to the following part or parcel of land lying and being in The County on the waters of Higgins Branch on the North Side of the Caney River Mountain bounded as follows: Beginning on a beach tree, Massey Higgins S.E. Conner & runs with her line N. 26 degreess West Nineteen Poles to a Black gum & hickory near Said line on the east bank of the branch; Thence North 28 degrees E up the ridge to a white oak on the top of the Burnt Knob ridge; thence with the main hight of Said ridge to the top of Caney River Mountain; thence a western course along the main lot of Said Caney River Mountain to a Stake at the instersection of Cliff Knob Ridge with Said Caney River Mountain, thence down the clif knob Ridge to or opposite Massey Higgins corner Thense with her line to the Beginning all the cove on Blunt Speculation land included in the above limits not heretofore Sold: and no more be the Same more or less Supposed to contain one hundred acres more or less. To have and to hold the aforesaid tract or parcel of land Except The reservations herein before made up one half of the minerals unto the Said William Wheeler and his heirs to his and their only use and behoof for even And the Said Robert McIntosh hereby binds himself and his heirs Executors and Administrators and all persons wharsoever to William Wheeler and his heirs for ever for Testamony where of the Sai d Robert McIntosh has hereunto Set his hand and Seal this 28 day of October A.D. 1874
