Know all men by these presents that I John Wheeler and wife Lovada Wheeler of the County of Yancy and State aforesaid in consideration of the sum of Seventy-five dollars to us in hand paid by James H. Higgins the Receipt of which is hereby acknowledged have bargained and sold granted and conveyed and by these presents do give grant convey bargain and sell unto James H. Higgins his heirs and assign all that had or parcel of land situated in Yancy County State of North Carolina lying near the waters of Hog Branch on the left hand fork of the same joining lands of Marian Higgins and others beginning on a chestnut on top of the old field ridge and running down said ridge with the extreme right of said ridge to the Hog Branch then up the Hog Branch to the middle fork of said branch then up the middle fork of Hog Branch to James Higgins old line thence down said ridge with the height of said ridge to the beginning containing twenty acres more or less together with all the rights ways privileges and appurtenances in any wise to said land appurtaining and beglonging to have and to hold the aformentioned land and premises to the said James H. Higgins his heirs and assigns to his and them use and behoof forever and I the said John Wheeler for myself my heirs executors and administrators, do covenant with the said James H. Higgins his heirs and assign that I am lawfully seized in fee simple of the afore granted lands and premises that they are free from all incumbrances of any and every kind whatsoever that I have a good right to sell and convey the same to said James H. Higgins as aforesaid and that I will my heirs executors and administrators shall warrant and defend the same to the said James H.Higgins his heirs and assigns foever against the lawful demand of all persons whatsoever in testimoney of all which things we have herunto let our hands and seals this 11 day of April 1881.

On 9 Sep 1877 when John Bomar was 25, he married Nancy Lovada Higgins8, daughter of Unknown Unknown & Margaret Higgins, in Yancey County North Carolina. Born on 9 Apr 1862 in Higgins Yancey County North Carolina. Nancy Lovada died in Jacks Creek Burnsville  Yancey County North Carolina, on 9 Dec 1942; she was 80.19,5

 

Research: John was 22 & Lovada was 18 both were white married by L. S. Phillips Justice of the Peace, witnesses were W. A. Byrd & Theseway  Higgins.20

Also I have seen where Theseway could be Thrower & W.N. Billings was another witnesses.
