Sanders Sent. (N), Martin (S), Clark and Linder (E), Benja. Champin decd. (W), Saml. Dunaway. By computation 300 acres more or less. Witness Fielding Turner, Amos D. Ring. Signed John (x) Sanders. Witness oath by Amos D. Ring 24 Sept 1830 to Henry Turner, J.Q. Recorded 29 Sep 1831.

COMMENT: Thickety Creek is about 10 miles east of the Turner Homeplace near the Pacolet River. It is also the general area that several of Martin Martin's sons lived in. I cannot explain why these folks came to Henry Turner, except an Officer of the Court was required to make the transaction legal. Apparently, Fielden was used as a witness.

THIS INDENTURE MADE THIS THE 12 TH DAY OF JANUARY IN THE YEAR OF OUR LORD ONE THOUSAND EIGHT HUNDRED AND FORTY SIX BETWEEN RICHARD SCRUGGS OF SPARTANBURG DISTRICT AND STATE OF SOUTH CAROLINA OF ONE PART AND JESSE SCRUGGS OF THE DISTRICT AND STATE AFORESAID OF THE OTHER PART. S35E 45 poles to a poast oak - Thence on another line of said land S42E 80 pole to an old dead red oak - Thence with said line and Morrow S1OW 182 pole to a poast oak Thence with Potter line S82W 54 pole to a stake in said line - Thence with said line N7W 150 pole to a small cherry tree - Thence S85W with Potter line 168 pole to the beginning. Be the same two hundred and 67 acres more or less-being part of a tract of 455 acres granted to William Abbott bearing date 6th September 1803

1. Richard Scruggs is Richard Scruggs 11 1762 - 1855, the son of Richard Scruggs I and Prudence Hicks.

2. Jesse Scruggs is Jesse M. Scruggs, Sr., 1795 - 1882, son of Richard II. He married Mary "Polly" Martin, daughter of Martin Martin and Dicey Hicks.

3. James L. Scruggs is Jesse Lewis Scruggs and the son of Jesses Scruggs Sr.

4. John Martin, Jr., is probably John M. Martin, Jr., the son of Jeremiah and Charlotte Bonner Martin, and nephew of Jesse and Polly Scruggs.

5. W. B. Turner is William B. Turner husband of Jane Martin, the daughter of Martin Martin and Dicey Hicks.

Know all Men by these Presents, That I, Robert Scruggs of the County of Spartanburg in the State aforesaid, for and in consideration of the love and affection I have for my daughter Sarah E. Roberts of the County of Spartanburg in the State aforesaid, have granted, give and released, and by these Presents do grant, give and release, unto the said Sarah E. Roberts a certain lot or parcel of land lying and being in the County and State aforesaid; situated on the mack branches of Island Creek and bounded by lands belonging to Mary Williams, M. J. Lawson, J. A. Scruggs and others and having the following metes and bounds (viz),

 

Beginning at a stake and running N49W 4 to a Hickory, thence N34E 20.50 to a stake, thence N25E 5 to three chesnuts, thence N37Y2E 18 to Red Oak, thence N31 W 38 to a stake, thence along M. J. Lawsons line to the beginning corner. Containing Fifty two (52) acres, more or less.

 

TOGETHER with all and singular the rights, members, hereditaments and appurtenances to the said premises belonging or in anywise incident or appertaining: TO HAVE AND TO HOLD all and singular the premises before mentioned unto the said Sarah E. 1. Robert Scruggs is Robert Stobal Scruggs 1800 - 1890, the son of Richard II and Mary "Mollie" Dobbins Scruggs. Robert married Nancy Catherine Connell.

2. Sarah E. Roberts is Sarah "Sallie" E. Scruggs, daughter of Robert Stobal Scruggs and married to William J. Charles Roberts.

3. J. W. Cabaniss is probably J. William Cabaniss 1848 - 1938. He may have been the husband of Parthenia Elizabeth Scruggs, a niece of Robert Stobal Scruggs, but this is not proven.

4. P. Lawson has not been identified.

Scruggs of the County of Spartanburg in the State aforesaid, have granted, bargained, sold and released, and by these Presents do grant, bargain, sell and release, unto the said James A. B. Scruggs a certain lot or parcel of land lying and being in the County and State aforesaid; situated on the head waters of Island Creek, And bounded by Willis Martin and P. Lawson and W. J. C. Roberts and Miss Blackwell,

hence the line from the stake on the branch, thence with line Parris to the Road, thence with the Road to D. S. Scruggs line, Thence across with said line to the old Williams Post Oak, thence with Williams line to a pine, thence to a white oak, thence with Susans line to a sweet gum, Thence across the branch to another corner but straight, thence to Drury Williams Post Oak, thence to the Chestnut at Willis's line, thence running with Willis line, Containing Two Hundred and twenty four acres more or less.

2. James A. B. Scruggs is James Augustus B. "Black" Scruggs 1848 - 1923, son of Robert Stobal Scruggs. James married Mary Ellen Hames.

3. E. M. Martin cannot be positively identified. He could be Edley Martin 1859 - 1927, son of Othello and Sally Washburn Martin. He is the only male "E." Martin in Spartanburg County during this time period.

 Thomas Tod to Samuel Farrow, Esquire       Deed #376               June 10, 1791

 SOUTH CAROLINA} To all whom these presents shall come, know ye that I, Thomas Tod of Spartanburg County in the state aforesaid Farmer, have for and in consideration of five pounds sterling money to me in hand paid by Samuel Farrow, Esquire high sheriff of the county aforesaid, have bargained, sold, aliened, released, conveyed, and confirmed and by these presents do bargain, sell, alien, release, convey, and confirm unto the said Samuel Farrow, Esquire, his heirs, and assigns forever all that plantation, tract or parcel of land containing three hundred acres {more or less} with every appurtenance thereunto belonging or in anywise appertaining, situate, lying, and being in the county and state aforesaid on the north side of Enoree River, bounded south by said river, east by James Benton’s land and west by James Couch’s land.  It being part of a tract of four hundred and fifty acres of land granted to Charles Waters by his excellency William Moultrie, Esquire, October 25, 1786, which said three hundred acres of land and appurtenances thereunto belonging, were seized and sold for the debt of the said Charles Waters and purchased by me at public sale of the said Samuel Farrow, Esquire high sheriff aforesaid, which said three hundred acres of land and appurtenances the said Thomas Tod doth hereby for himself, his heirs and assigns warrant and defend to the said Samuel Farrow, his heirs and assigns from and against himself, his heirs, and assigns and all persons acting by, from, or under him, his heirs and assigns but against such persons only.  In witness whereof I have hereunto set my hand and seal this 15th March Anno Domini, 1790.

Fielden Turner to Fielden Sanford Turner

DEED BOOK Y, PP 245-246; 23 FEB 1843. Flelden Turner (Spartanburgh Dist) have this day give and bequeathed to my beloved son Flelden Sanford Turner a negro boy Jackson in his own right forever, with the following conditions annexed, that if Flelden Sanford Turner shall die without lawful heirs, before he arrives at the full age of 21 years (he now being about 5 years old), then the above named negro boy Jack shall revert back to said Flelden Turner, after my brother Henry Turner has had the use of said boy Jackson, until the said boy shall be 21 years old (he being now about 1 year old), for his trouble in raising the above named children. It is fully understood that my son Fielden Sanford Turner shall have at my decease $100 less of my Estate that the rest of my lawful heirs in the division of the same. Witness John Low, J. W. Martin. COMMENT: This document is believed to have been written by Fielden himself as an Attorney. It is the first identification of his son Fielden Sanford Turner. Fielden, Sr. must have had an indication of ill health as this document was made to insure his son would inherit his fair share of Fielden Sr.'s property.

(Same), for $800 sold all that tract of land containing 300 acres more or less, in said Dist., on the south side of Pacolet river. Border: Lem Giliman, Island Creek, Cherokee Creek, Richard Turner, Templeman. Witness Arthur Dewberry, Samuel Linder. Signed Fielding Turner. Witness oath by Arthur Dewberry 18 Jan 1836 to Henry Turner J. Q. Dower relinquished by Nancy (x) Turner 18 Jan 1836 to Henry Turner, J.Q. Recorded 2 Feb 1836.

 

COMMENT: It is not known whether this is the tract of Land provided by Fielding's father, Henry, in Henry's Will, or not. Nancy Turner is Fielding's wife. Henry is Fielding's Father. Richard could be Henry's brother.

COMMENT: William, Edward and James are probably sons of James Turner and Margaret Headen, and First Cousin to Henry. This Nancy is the wife of William.

 Charles Waters to William Heaton; Bond #213

 Know all men by these presents that I, Charles Waters, Constable of Enoree in Ninety Six District in the state of South Carolina, am hold and firmly by these presents bound unto William Heaton of Tyger River in the said district and state aforesaid farmer in the penal sum of five hundred pounds sterling money to be paid to the said William Heaton, his certain attorney, his heirs, executors, administrators or assigns to which payment well and truly to be done, made, and paid.  I firmly by these presents bind myself, my heirs, executors, administrators and every of them as witness my hand and seal this 19th day of October Anno Domini 1784.

 The condition of the above obligation is such that if the above bounden Charles Waters, his heirs, executors, administrators shall and so make or cause to be made unto the above said William Heaton, his heirs or assigns a sure and absolute indefeasible right in fee simple to a certain tract or plantation of land containing two hundred and twenty five acres of land situate lying and being on the north side of Enoree River and bounded southerly by the said river and on land laid out to James Benton and on land of said Charles Waters and the Irish line which two hundred and twenty-five acres of land is also bounded on land laid out to James Couch being part of a tract of four hundred and fifty acre tract of land lately surveyed by the above bound Charles Waters from the location office, then the above obligation to be void and of no effect, else to remain and be in full force and virtue in law.  As witness my hand and seal the day and year above written and sealed and delivered in the presence of witness present:

Personally, Edward Musgrove, the witness present to the within bond appeared before me one of the county justices assigned to keep the peace in Spartanburg County and being duly sworn on the Holy Evangelist on his oath saith that he wrote the within bond the day and year within mentioned and then subscribed his name to the same after the within named Charles Waters had signed his mark and delivered the same, acknowledging the seal thereon made to be his seal and further saith that the said Charles Waters also acknowledged that he has received full payment to his satisfaction of the said within named William Heaton for the said two hundred and twenty five acres of land in hand to him the said Charles Waters before the within bond given and delivered for the use within mentioned.

Know all men by these presents that I, John Weaver and Alcy Weaver of the State and District aforesaid of the first part and Jeremiah Martin of the other part witnesseth that the said John Weaver and Alcy Weaver doth for and in consideration of the sum of one hundred and thirteen Dollars paid to us in hand by the said Jeremiah Martin doth grant, bargain, sell and Relinquish unto the said Jeremiah Martin, his heirs, assigns forever


a certain Tract and parcel situated in the State and District aforesaid being and lying on Each side of the Road that leads from Coulters Ford to Rutherford Court House. Known as the land of Shadric Weaver, Eighty acres that's coming to his Five Grandson's, John Weaver and Jacob Weaver and Thirty Three acres of Sarah Weaver's that is her's her lifetime joining lands to Jones', Young's, Cantrell's and Martin's the courses and distances not known.

O. P. Vernon as Commissioner, did on 6 Oct 1845, dispose of said lot unto D. Whereas William Martin, Jerry Martin, O. Martin, et. al, on about the day of one thousand eight hundred and did exhibit their petition in the Court of Probate at Spartanburg Court House, setting forth that Martin Martin departed this life on or about day of one thousand eight hundred and seized and possessed in fee of a certain plantation or tract of land containing Forty six and two thirds acres, more or less, bounded by lands of James Harris, Calvin Phillips, that portion and division of said lands, yet remained to be made, which they prayed might be done.

 

And whereas, afterwards, to wit: On the Eleventh day of November, in the year of our Lord one thousand and eight hundred and Seventy one, Benj Wofford Esq Probate judge of Spartanburg County, after due examination did order and decree that the land described in the said petition be sold by the Sheriff of Spartanburg, on the first Monday in December, the next ensuing or on such other sale day as would be most for the advantage of the parties in interest, in a credit of twelve months, with interest from date, except costs which must be paid cash on day of sale. And whereas John Dewberry, as Sheriff of the County aforesaid, after having duly advertised the said tract of land for sale by public outcry, on the fourteenth day of December, in the year of our Lord one thousand eight hundred and seventy one, did then openly and publicly and according to the custom of Auction, sell and dispose of the tract of land below described unto C. P. Turner, of the County and State aforesaid for the sum of Thirty five dollars ($35.00) dollars, he being at that price, the last and highest bidder for the same. Now therefore know all men by these presents, that I, Benj Wofford Esq., Probate Judge as aforesaid, under and by virtue of the order and decree of the Probate Judge aforesaid, and in consideration of the sum of ($35.00) Thirty five, secured to be paid to the Probate Judge, aforesaid, have granted, bargained, sold and released, and by these presents do grant, bargain, sold and released unto the said C. P. Turner, that certain piece, parcel, and plantation of land containing one hundred and twenty acres, more or less, adjoining lands of James Harris, Calvin Phillips, So Ca Manufacturing Company and others, lying on the head waters of Thicketty creek, in the county and State aforesaid. The interest herein conveyed and released, is the interest of the aforesaid Martin Martin, deceased, which is seven (7/18) Eighteenths of the whole tract above mentioned and described. Together with all and singular, the rights, members, hereditaments and appurtenances belonging, in anywise incident or appertaining to the said promises and also of the state, right, title, interest, dower, possession, property, claim and demand, whatsoever, either at law or equity of the heirs and representatives of the said Martin Martin, deceased, and of the parties to this suit, or any other person rightfully claiming or to claim the same or any part thereof, by, from, or under their or either of them. To have and to hold the said tract of land, with its appurtenances hereditaments and privileges, unto the said C. P. Turner, his heirs and assigns, to his, and their proper use and benefit forever. In witness whereof, I, the said Benj Wofford, Esq., Probate Judge of the County aforesaid, under and by virtue of the said order and decree, have hereunto set my hand and seal, this fourteenth day of December, in the year of our Lord one thousand eight hundred and Seventy one, and in the Ninety Sixth year of the Sovereignty and Independence of the United States of America.

 Benjamin Wofford to Henry Meredith; Deed #16

 This Indenture made the 19th day of October in the year of our Lord One Thousand Seven Hundred and Eighty Five between Benjamin Wofford and Burrell Thomson of the state of South Carolina of the county of Spartanburg of the one part and Henry Meredith of the county and state aforesaid of the other part.  Witnesseth that for and in consideration of the sum of three hundred pounds sterling money to them in hand paid by the said Henry Meredith at and before the sealing and delivery of these presents, receipt and payment is hereby acknowledged; hath granted, bargained, and sold, aliened, conveyed unto the said Henry Meredith to him, his heirs, executors, administrators and assigns forever all that Mesuayer Tract of land containing five hundred acres more or less being a part of six hundred acre tract lying and being on both sides of the Enoree River, granted unto Thomas Irvin by the honorable Arthur Dobbs, Governor of North Carolina bearing date the twenty sixth day of March in the year One Thousand Seven Hundred and Fifty-five.  Enrolled in the Auditor Generals office the 27th day of March 1755 and recorded in the Secretary’s office by James Arhdnd and conveyed to Bartlett Brown, Sr., deceased the eleventh day of May 1755.  It being that part west of one hundred acres sold on the north side of Enoree River to Mathew Couch out of the above six hundred acres, lying on both sides of said river, the north side being in Spartanburg County and the south side of said river in Laurens County.  Beginning at the above Mathew Couches, on said six hundred acre line and running north to the red oak corner thence 78 chains to a white oak thence south 78 chains to a pine thence to the beginning tree of the six hundred acre tract a cedar at the upper end of the Fort Shoal, thence up the said Enoree to a poplar Mathew Couches corner, thence up the said Couches line to the beginning with the appurtenances, situate lying and being as aforesaid with their and every of their rights, members and appurtenances whatsoever, and the reversion and revisions, remainder and remainders of all and singular the lands and tenements, hereditaments and premises hereby granted and intended to be granted and of every part and parcel thereof and rents, houses, surveys, profits to him or any of his or any part or parcel of them residing, belonging, or appertaining and also all and every estate, estates, rights, claims, interest, and demand whatsoever of them the said Benjamin Wofford and Burwell Thomson of or unto the said lands, tenements, premises hereby granted with the appurtenances to the said Henry Meredith, his heirs, and assign.  The said Benjamin Wofford and Burwell Thomson for themselves, their heirs, executors, and administrators shall and will at all times warrant and defend the said premises to the said Henry Meredith, heirs, executors, and administrators and assigns, against all grant and every claim or claims that shall or may arise form the said Benjamin Wofford and Burwell Thomson or any other person, our heirs, executors, administrators or assigns forever whereby the above mentioned premises might or may be effected or encumbered by any grant or bond or the above mentioned Benjamin Wofford and Burwell Thomson their, heirs, executors, and administrators or assigns contrary to the interest and meaning of these presents.  In witness whereof the said Benjamin Wofford and Burwell Thomson hath hereunto set their hands and affixed their seals the day and year first above mentioned.
